I don't know... I read a little of the testimony from this trial. There is no way I would have voted for murder, 1st or 2nd degree. I would have thought an "involuntary manslaughter" charge could have been made, but... I'm not sure what is really required for that. You do know, the bullet that killed her ricocheted off a pole first? There was never any evidence that showed any reason why he would have killed her on purpose.

Me too - manslaughter or involuntary manslaughter...If it's true it was a ricochet....
Kind of like the Zimmerman case, they overcharged and the jury would not find him guilty.

Involuntary manslaughter was one of the options offered to jurors. But, I don't see where the prosecutors proved the guy was committing a crime at the time, or acting recklessly. I guess, BEING here is a sort of crime. But, I don't think it qualifies.
With VERY rare exceptions (Like OJ) I have very healthy respect for the jury process. Far more often than not, when I take the time to investigate the details of a trial (as they had to do) I end up agreeing with the verdict.
Apparently, this shooting was a tragic accident, that involved a guy who shouldn't be in the country. It could have been anyone.

The shot had ricocheted before striking Steine. Zarate was overcharged.

Which, seem appropriate to me, given what happened... IF it the shooting really was an accident.. as, all indications point to. I think he will also be prosecuted for coming here illegally multiple times... which, is a good thing. This was a good case, IMO, to rail against Sanctuary Cities... he SHOULDN'T have been here. FIVE times deported, and a convicted criminal. That's all good fodder to use against San Fran. But, murder is a different thing. It wasn't proven in this case. And, the implication of murder has been grossly overplayed by Trump, and many other conservatives. I don't think that kind of exaggeration helps our cause, in the long term. I'm comfortable that justice has been and will continue to be served in this case.
